Article 1. Purpose of this Privacy Policy

The purpose of this Privacy Policy is to inform website visitors, prospective customers, customers, business partners and any other individuals whose personal data is processed by SIMPL. SRL of the ways in which such data is collected, used, stored and protected.

SIMPL. SRL attaches particular importance to the protection of privacy and ensures that personal data is processed in accordance with the provisions of Regulation (EU) 2016/679 (‘GDPR’), the applicable Belgian legal provisions, and the principles of lawfulness, fairness, transparency, data minimisation and purpose limitation.

The actual processing carried out varies depending on the nature of the relationship with SIMPL. SRL and the services requested.

Article 2. Data Controller

SIMPL. SRL acts as the data controller when it determines the purposes and means of the processing carried out in the course of its own activities.

However, certain services provided on behalf of its clients may require SIMPL. SRL to act as a data processor within the meaning of the GDPR. In such cases, the personal data concerned is processed exclusively in accordance with the documented instructions provided by the client and the obligations applicable to data processors.

Article 3. Categories of personal data that may be processed

Depending on the nature of the services provided, SIMPL. SRL may be required to process, in particular, the following categories of personal data:

  • identification data such as surname and first name;
  • business contact details such as business email address, business telephone number and job title;
  • data provided in connection with contact enquiries and requests for quotations;
  • data necessary for the administrative, contractual, accounting and financial management of relationships with customers and business partners;
  • data relating to contact persons designated by customers;
  • technical data necessary for the administration, maintenance and security of the digital services covered by the agreed services;
  • connection and browsing data collected whilst using the website;
  • data contained in electronic correspondence or other communications with SIMPL. SRL;
  • any other data strictly necessary for the performance of the agreed services or to comply with applicable legal obligations.
  • SIMPL. SRL ensures that the collection of personal data is limited solely to information that is adequate, relevant and necessary in relation to the purposes pursued.

    Article 4. Purposes and legal bases for processing

    Personal data is processed exclusively for specific, explicit and legitimate purposes.

    The processing carried out by SIMPL. SRL serves, in particular, the following purposes:

  • to respond to contact enquiries and requests for quotations addressed to the company;
  • to ensure the negotiation, conclusion and performance of contracts entered into with clients;
  • to manage administrative, commercial, accounting and financial relations with clients and business partners;
  • to ensure the provision of the agreed services, in particular digital communication, graphic design, web development, technical maintenance and strategic support;
  • to provide technical support, maintenance, security and the proper functioning of the services provided where such assistance is contractually stipulated;
  • manage access to the digital tools used in the context of the services provided;
  • ensure the security of IT systems, the website and the services offered;
  • comply with applicable legal, regulatory, accounting and tax obligations;
  • ensure the retention of the information necessary for the purposes of providing evidence and defending the legitimate rights and interests of SIMPL. SRL.
  • This processing is primarily based on:

  • the performance of pre-contractual measures requested by data subjects prior to the possible conclusion of a contract;
  • the performance of the contractual obligations to which SIMPL. SRL is bound in relation to its clients;
  • compliance with the legal obligations to which SIMPL. SRL is subject;
  • the legitimate interest pursued by SIMPL. SRL, consisting in particular of ensuring the normal management of its business activities, the security of its IT systems and the defence of its rights in the event of a dispute;
  • the consent of the data subjects where required by applicable regulations, in particular regarding non-essential cookies.

  • to prepare a commercial offer or quotation;
  • to carry out administrative follow-up on the correspondence exchanged;
  • to communicate with you in connection with the performance of the pre-contractual measures requested.
  • This processing is based primarily on the performance of the pre-contractual measures requested, as well as on the legitimate interest pursued by SIMPL. SRL, which consists of ensuring the normal management of its business activities.

    Article 7. Data processed in the context of contractual relationships with customers

    In the course of performing the services agreed with its clients, SIMPL. SRL may need to process personal data strictly necessary for:

  • the management of contractual relationships;
  • the provision of the services ordered;
  • the administrative, accounting and financial management of contracts;
  • communication with the contact persons designated by clients;
  • the maintenance, support and security of the services provided;
  • administering the access rights necessary for the performance of the agreed services.
  • Depending on the nature of the services commissioned, SIMPL. SRL may need to carry out work on websites, digital platforms or technical environments administered on behalf of its clients.

    When acting exclusively on the documented instructions of a client in the context of processing carried out on its behalf, SIMPL. SRL acts as a data processor within the meaning of the GDPR.

    Article 8. Recipients of personal data

    Personal data processed by SIMPL. SRL is accessible only to those persons whose involvement is necessary for the fulfilment of the intended purposes.

    In particular, such data may be disclosed:

  • to employees or service providers involved in the provision of the agreed services;
  • to providers of hosting, maintenance, security and data storage services;
  • to providers of cloud services, collaborative tools, electronic communication, automation or analytics services where their involvement is necessary for the performance of the agreed services;
  • to administrative or judicial authorities where disclosure is required by a legal or regulatory obligation.
  • SIMPL. SRL ensures that third parties to whom personal data is disclosed provide appropriate safeguards regarding confidentiality and the protection of personal data.

    Article 9. Possible transfers outside the European Economic Area

    Certain technical service providers used in connection with SIMPL. SRL’s activities may be located outside the European Economic Area or may be required to carry out processing operations involving the international transfer of personal data.

    Where such a transfer is necessary, SIMPL. SRL ensures that it is based on one of the mechanisms provided for by the GDPR, in particular the existence of an adequacy decision adopted by the European Commission or the implementation of appropriate safeguards such as the standard contractual clauses adopted by the European Commission.

    Article 10. Retention periods

    Personal data is retained for a period not exceeding that necessary for the purposes for which it is processed and in accordance with applicable legal obligations.

    As a guide:

  • data relating to contact requests and quotes is retained for the period necessary to process the request and, where applicable, for the period necessary to follow up on the correspondence exchanged;
  • data relating to contractual, administrative, accounting and financial matters is retained for the periods required by applicable legal and tax obligations;
  • data necessary for the performance of services provided is retained for the duration of the contractual relationship and for as long as is necessary to exercise or defend the rights of SIMPL. SRL;
  • technical data necessary for system administration and security is retained for a period proportionate to the purposes pursued and to the applicable security requirements;
  • documents and correspondence necessary for the purposes of providing evidence or defending the legitimate interests of SIMPL. SRL may be retained for the applicable limitation periods.
  • Upon expiry of the applicable retention periods, personal data shall be deleted, anonymised or archived where its retention remains required or authorised by the applicable regulations.

    Article 11. Data Security and Confidentiality

    SIMPL. SRL implements appropriate technical and organisational measures designed to ensure a level of security appropriate to the risks posed by the processing operations carried out.

    These measures are specifically designed to protect personal data against accidental or unlawful destruction, accidental loss, alteration, unauthorised disclosure or unauthorised access.

    Access to personal data is restricted solely to those persons whose involvement is necessary in view of the purposes pursued.

    Article 12. Your rights

    In accordance with the applicable provisions of the GDPR, you have, in particular, the following rights:

  • the right to obtain information regarding the processing carried out on your personal data;
  • the right to access your personal data;
  • the right to request the rectification of inaccurate or incomplete data;
  • the right to request the erasure of your data in the cases provided for by the applicable regulations;
  • the right to request the restriction of certain processing activities;
  • the right to object to processing based on the legitimate interests pursued by SIMPL. SRL under the conditions set out in the GDPR;
  • the right to data portability where the conditions set out in the GDPR are met;
  • the right to withdraw your consent at any time where processing is based solely on that consent.

    Article 13. Lodging a complaint

    Without prejudice to any other administrative or judicial remedy, any data subject has the right to lodge a complaint with the Data Protection Authority if they consider that the processing of their personal data constitutes a breach of the applicable provisions of the GDPR.
